Witnesseth, That the landlord hereby leases to the tenant, the premises located at Edgartown - Katama.

This lease shall begin at 3 p.m. on Sunday, , 2006 and end at
10:00 a.m. on Sunday, , 2006

And for such term the tenant agrees to pay $ per week, which includes utilities such as oil, electricity, and trash removal, cleaning etc. Telephone toll calls are not included.

The landlord hereby acknowledges receipt of 50% deposit or $to be completed by landlord as payment of the initial deposit. The landlord will upon receipt of the second payment of $to be completed by landlord provide the tenant with written receipt of the same.

And for the heretofore described term, the tenant further agrees to pay $ 500.00 as a security deposit, receipt of which the landlord hereby acknowledges; it being understood that said security deposit is not to be considered prepaid rent, nor shall any damages claimed (if any) be limited to the amount of said security deposit.

The landlord hereby notifies the tenant that the landlord, or his agent, will submit to the tenant an itemized list of any damages claimed to have been caused by the tenant and return the entire security deposit less damages and other lawful deductions, within sixty (60) days after the termination of the lease.

The landlord hereby notifies the tenant that David & Heather White, P.O. Box 324, Walpole, MA 02081 are the persons authorized to receive notices of violations of law and to accept services of process on behalf of the owner.

Addendum to Lease

The LANDLORD hereby notifies the TENANT that the LANDLORD is the person authorized to receive notices of violation of law and to accept services of Process.

The parties hereto in consideration of these presents, agree as follows:

  1. That no more than 8 persons will occupy said premises.
  2. SMOKING and PETS will not be allowed on the premises.
  3. That no animals, birds or pets of any description shall be kept in or upon the leased premises without written permission of the LANDLORD, and if any pets are found on premises, this will constitute a violation of the terms of the terms and conditions of this lease and will result in an immediate eviction. If said eviction occurs, all rents and security deposits herein shall be forfeited.
  4. The TENANT will be responsible for all damage or breakage and/or loss to the premises, except normal wear and tear and unavoidable casualty that may result from occupancy.
  5. The LANDLORD will prepare the premises for occupancy and the TENANT will maintain in good order for the full term on this lease and vacate the premises peaceably and quietly leaving it in like condition in which the occupancy was taken; all laundry and house to be left clean and ready for the next occupant. TENANT is further responsible for all damages or breakage and/or loss to the premises except normal wear and tear. In the event the cleaning supervisor determines that the aforementioned conditions have not been complied with, the TENANT will be assessed the cleaning costs necessitated by the work needed to make the house acceptable for the incoming tenant. Unless included in the rent, a reasonable expense for housecleaning immediately following said tenancy will be deducted (along with any other charge) from the security deposit.
  6. The TENANT will supply bed linens, towels.
  7. The LANDLORD will provide the TENANT with a current copy of the association rules/covenants if said LANDLORD is bound by any such bylaws; and the TENANT would then therefore agree to be bound by the same, and any breach of any such bylaw would be deemed a default of this lease.
  8. If the TENANT defaults and/or otherwise fails to comply as regards any item in this lease, the TENANT agrees to vacate said premises upon receipt of proper notice from LANDLORD and/or upon proper commencement and final adjudication of proceedings authorized and/or required by the applicable laws and regulations of the Commonwealth of Massachusetts.
  9. The TENANT agrees to allow the LANDLORD or his agent to reasonably enter and view the premise, both inside and outside: A) to inspect the premises; B) to make repairs thereto; C) to show the same to a prospective TENANT or PURCHASER with 24 hours notice; D) pursuant to a court order; and E) to protect the premises if it appears that said premises have been abandoned by the TENANT.
  10. The TENANT and LANDLORD agree that should the premises be destroyed by fire or other casualty so as to become unfit for human habitation that these presents shall thereby be ended, with refund to the TENANT for any rent unused.
  11.  Subject to the provisions of the previous paragraph, the LANDLORD agrees that if the premises acquire a condition which amounts to a violation of the law which may endanger or materially impair the health, safety or well being of the TENANT, or becomes unfit for human habitation; upon proper notice to or discovery by the LANDLORD thereof, the rent or a just portion thereof according to the nature and extent of the condition shall be suspended or abated until the condition is remedied, if such remedy is reasonably possible during the lease term; provided, however, that said condition or violation of law was not caused by the TENANT or others lawfully upon said premises.
